Waiver of Liability. Auctioneer shall not be liable for, and Buyer assumes all risk of, any injury, damage or illness incurred by any person, property or vehicle, during or in any way arising out of entry into or upon the seller's premises for any reason including inspection of item(s) and pick up of item(s) purchased, including but not limited to claims for personal injury, property damage, medical expenses, and loss of services.

Terms: Buyer’s premium of 13% will be added to the final bid price. NO PERSONAL CHECKS OR CASH ACCEPTED. Business checks may apply for exemption. You may pay by Visa, Master Card, Discover, Diners Club, American Express or paypal. Wired funds option is available for an additional fee. Sales Tax will apply where applicable and listed on the individual terms of each project, if applicable.

After the auction is over you will receive an invoice via your registered email with the 13% Buyers Premium added. If you do not receive an invoice by 6:00am of the next day please contact The Appropriate Project Manager for each project. PROJECT MANAGER CONTACT INFO IS LOCATED ON THE FRONT PAGE OF EACH AUCTION WHICH ALSO HOUSES THE GOOGLE MAP FOR THAT LOCATION. Payment is collected at the time of pick-up. IF YOU DO NOT PAY FOR AND PICK UP YOUR ITEM(S) ON THE ALLOTTED DAY AND TIME YOU ARE STILL RESPONSIBLE TO PAY FOR THE ITEMS IN FULL TO MAINTAIN YOUR BIDDING PRIVILEGES, AND YET THE ITEMS ARE CONSIDERED ABANDONED. IF FUNDS ARE NOT RECEIVED BIDDING WILL BE SUSPENDED AND ANY EXISTING BIDS ON OTHER AUCTIONS WILL BE DELETED UNTIL ITEMS ARE PAID IN FULL. A $25 REINSTATE FEE WILL APPLY!

BUYERS ARE RESPONSIBLE FOR ALL SHIPPING COSTS AND ARE RESPONSIBLE TO KNOW THE SHIPPING COST OF THE ITEM TO PURCHASE PRIOR TO WINNING THE ITEM AT AUCTION SO AS TO KNOW THE TOTAL DUE. THE BUYER MUST MAKE ALL NECESSARY SHIPPING ARRANGEMENTS WITH THE SHIPPER AND PAY THE SHIPPER DIRECT. THE ITEMS MUST BE PAID IN FULL BY THE SCHEDULED TIME AND DATE OF PICK UP AND PRIOR TO THE SHIPPER RETRIEVING THE ITEM(S).

NO refunds, charge-backs or guarantees are offered. PLEASE REVIEW ALL ITEMS AND KNOW THE ITEMS YOU MAY WIN. Unless other arrangements have been made, after the scheduled pickup date and time, items will be considered abandoned. Bring labor for pick-up as well as boxes/containers and packaging if necessary.

Increasing your own bid/Bidding Errors
Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. Our software will allow you to increase your own bid due to this bidder/buyer strategy. Therefore you should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact our office by email or use the contact sheet on our website. We will not reverse bids after the auction has closed no exceptions.

Staggered Closing:
The online auction closes (number of items per minute is included in the auction header) item(s) every minute. This feature will close the bidding on intervals. This feature works great with the auto-extend feature to closely emulate a 'live' auction. If an item receives a bid within 5 minutes of ending the item will be extended 5 additional minutes. Please remember to hit the "REFRESH" button to know the time remaining on any items.

Dynamic Closing.
The closing time of an asset is automatically extended an additional 5 minutes whenever a bid is placed within the last 5 minutes of the asset's closing time. Otherwise the closing happens just as the start with each item closing at the same interval of separation as when they started.

Bid Notification:
If you have been outbid you will be notified by email ONLY UNTIL the last day of the auction --- starting at midnight EST the night before the ending of the auction notices are not sent.

Winning Bidder Notification:
You will be contacted by email ONLY (you are responsible for checking your email) If you feel you have won an item and have not received an email you must notify us by email or call the contact number given (John Rogers 614 499-5257 or john@irsauctioneer.com) immediately.

In the event an item is not available for pickup or is missing, the buyer must, notify our on-site staff. The project manager of the auction will make the necessary adjustments prior to you leaving the pickup location. After 24 hours of the actual pickup ending time, the Auctioneer and buyer agrees that no adjustment or refund will be made.

CAUTION:
Various items may be joined, do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions. YOU ARE PURCHASING THE DESCRIBED ITEM(S).

Catalog Inaccuracies:
You are bidding on the described item, unless otherwise described, not the photo. Possibly the wrong photo is displayed, always read the item description and call or email with any questions. BUT ALWAYS KNOW WHAT YOU ARE BIDDING ON BEFORE BIDDING!

WARRANTY & CONDITION OF ITEMS SOLD:
All items are sold "AS IS, WHERE IS”, with NO WARRANTY expressed or implied by the lot number affixed to the item, without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. If you are not certain of the condition or use of an item, please bid accordingly. You are bidding on the described item not the photo and previews are encouraged.

Bidders are responsible for their own removal/pickup. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid receipt. Please ensure that movers or anyone picking up items on your behalf have your paid receipt(s) at the pickup location. No items will be released without a paid receipt.

IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.

We want everyone to get a good deal and most will. However, please be sure that you want and get the item(s) on which you bid because ALL bids are final. When in doubt about condition, completeness or suitability for intended use, please bid accordingly and PLEASE PREVIEW ALL ITEMS WHEN IN DOUBT.

The auctioneer reserves the right to add or remove items from the auction. Split or combined lots. Add minimum bids or reserve prices. Cancel, suspend, extend or reschedule an individual item and or auction event. Make changes to the auction closing times or inspection or removal times

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Franklin County Ohio. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.

LIMITATIONS:
Individual auctions will have applicable terms and conditions that apply to that auction. All individual terms and conditions supersede “General” terms and conditions. Therefore all general terms and conditions apply unless the “individual” terms and condition conflict, in which case the individual terms and conditions apply. Final terms and conditions cannot be altered except in writing by the Auctioneer
